Terms & Conditions

These Terms & Conditions apply to purchases made through the Benjamine Cadette website and form part of the agreement between you and Benjamine Cadette.

By placing an order through our website, you confirm that you have read and accepted these Terms & Conditions.

You must be at least 18 years old or otherwise legally authorised to enter into a binding agreement to place an order.

We aim to present all pieces, descriptions, colours, measurements and prices as accurately as possible.

Colours may appear differently depending on your screen settings, device and lighting conditions. Minor variations may also occur because of the materials and production process.

Measurements are provided as a general guide. Please review the individual product information and size guide before placing your order.

We reserve the right to correct obvious errors in product descriptions, prices and other information displayed on the website.

Selected pieces may be offered during limited ordering periods and produced after orders have been confirmed.

Adding a piece to your cart does not reserve it. Availability is confirmed only when your order has been accepted.

We reserve the right to decline or cancel an order if a piece is unavailable, if the payment cannot be authorised, if the order information is incomplete or incorrect, or if an obvious pricing or technical error has occurred.

If we cannot accept an order after payment has been made, the relevant amount will be refunded to the original payment method.

After placing an order, you will receive an email acknowledging that we have received it.

This acknowledgement does not by itself mean that the order has been accepted.

The purchase agreement becomes binding when we send you an order confirmation.

Please review your order information carefully before completing your purchase. If you notice an error after placing an order, contact hello@benjaminecadette.com as soon as possible.

If you wish to change or cancel an order, please contact hello@benjaminecadette.com as soon as possible. Depending on the production status and applicable law, you may be responsible for reasonable costs resulting from a cancellation. This does not limit your statutory right of withdrawal or any other mandatory consumer rights.

All prices displayed on our website are in Swedish kronor (SEK) and include VAT.

The total amount payable will be shown before you confirm your order.

Payment is collected when the order is placed. Available payment methods are displayed at checkout.

You confirm that the payment information provided is accurate and that you are authorised to use the selected payment method.

If a payment is not authorised or is subsequently reversed, we may suspend or cancel the order.

Selected pieces are produced specifically after an order is confirmed. This allows us to create according to actual demand rather than hold unnecessary stock.

Production typically takes approximately four weeks after the relevant ordering period closes. The estimated production or delivery period may vary depending on the piece and production schedule.

The applicable estimated delivery information will be shown at checkout, included in the product information or communicated in the order confirmation.

We currently offer standard delivery within Sweden.

The available delivery method and estimated delivery period will be displayed at checkout or communicated when your order is confirmed.

Delivery dates are estimates unless a specific delivery date has been expressly agreed.

Risk in the piece passes to you when you, or a person appointed by you other than the carrier, receives it.

Further information about delivery, international inquiries, uncollected parcels and delays is provided in our Shipping & Returns policy.

International delivery is not currently available as a standard website checkout option.

If you are located outside Sweden and wish to place an order, please contact hello@benjaminecadette.com before ordering.

We will confirm whether delivery to your location can be arranged and provide information about the applicable delivery cost, taxes, duties and other conditions before the order is confirmed.

For eligible online purchases, you have the right to withdraw from your purchase within 14 days from the day after you receive your order.

A piece is not automatically excluded from the statutory right of withdrawal solely because it is produced after an order is placed.

The right of withdrawal may not apply where a piece is made to your individual specifications or is clearly personalised and the applicable statutory exception applies.

Instructions, conditions, return fees and refund information are provided in our Shipping & Returns policy.

Nothing in these Terms & Conditions limits any mandatory rights available to you under applicable consumer law.

If you receive a piece that is faulty, damaged or different from what you ordered, please contact hello@benjaminecadette.com as soon as possible.

Please include your order number and photographs that clearly show the issue.

Your mandatory rights under applicable consumer law are not limited by these Terms & Conditions. Where a complaint is valid, we will provide an appropriate remedy in accordance with applicable law.

You may use this website only for lawful personal purposes.

You must not misuse the website, attempt to gain unauthorised access, introduce malicious code, interfere with its operation or use its content for unauthorised commercial purposes.

We cannot guarantee that the website will always be available without interruption or free from technical errors. We may temporarily suspend access for maintenance, security or other operational reasons.

All content on this website, including designs, photographs, videos, text, graphics, logos and other materials, belongs to Benjamine Cadette or is used with permission.

The content is protected by applicable intellectual property laws.

You may view the website for personal use, but you may not copy, reproduce, distribute, publish, modify or commercially use any content without prior written permission.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful or limits your mandatory rights under applicable consumer law.

To the extent permitted by law, we are not responsible for indirect losses that were not reasonably foreseeable when the agreement was made.

We are not responsible for delays or failures caused by circumstances outside our reasonable control. If such circumstances materially affect your order, we will contact you and take reasonable steps to minimise the effect.

Personal information collected when you visit the website or place an order is handled in accordance with our Privacy Policy.

We may update these Terms & Conditions when necessary to reflect changes to our business, website, services or legal obligations.

The Terms & Conditions in effect when your order is placed will apply to that order.

These Terms & Conditions are governed by Swedish law.

This choice of law does not deprive you of any mandatory consumer protection available under the law of the country in which you normally reside.

If a dispute cannot be resolved directly with us, consumers in Sweden may refer the matter to the Swedish National Board for Consumer Disputes, Allmänna reklamationsnämnden (ARN), or another competent dispute-resolution body.

You may also bring a claim before a court with jurisdiction under applicable law.
